• SECTION 504

     

    Section 504 of the Rehabilitation Act of 1973 requires school districts to provide the full range of special accommodations and services necessary for students with special needs to participate in and benefit from public education programs and activities. Section 504 prohibits discrimination against persons with disabilities by school districts receiving federal financial assistance. Students with disabilities must be provided with a free, appropriate, public education (FAPE).

    Section 504 protects all students with disabilities, defined as those having any physical or mental impairment that substantially limits one or more major life activities. Major life activities include but are not limited to caring for one’s self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning and working. The ADA Amendments Act (ADAAA) of 2008 also includes “the operation of a major bodily function, including but not limited to, the function of the immune system, normal cell growth, digestive, bowel, bladder, neurological, brain, respiratory, circulatory, endocrine and reproductive functions.”

     

  • Child Find Notice

    Schools are required to locate, identify and evaluate all children with disabilities from birth through age 21. The Child Find mandate applies to all children who reside within a State, including children who attend private schools and public schools, highly mobile children, migrant children, homeless children, and children who are wards of the state. (20 U.S.C. 1412(a)(3))

    This includes all children who are suspected of having a disability, including children who receive passing grades and are "advancing from grade to grade." (34 CFR 300.111(c)) The law does not require children to be "labeled" or classified by their disability. (20 U.S.C. 1412(a)(3)(B); 34 CFR 300.111(d)).

    §504 Child Find Notice

    Pursuant to Section 504 of the Rehabilitation Act of 1973, the District has a duty to identify, refer, evaluate and if eligible, provide a free, appropriate public education to disabled students.
